Unfortunately, it is not uncommon for individuals to become injured because of the negligent acts of others. Injuries can include soft tissue injuries to severe life altering injuries and even death. These injuries often have a significant impact on the lives of those injured, and their families. This includes the pain caused by injures, medical bills to treat the injuries, and the inability to earn a wage.
While negligence is generally not a criminal act, our legal system is setup so that those injured can be compensated for their losses by the negligent party. The process to maximize and obtain compensation for your injures is complicated and can require the use of expert witnesses to show you are entitled to a recover as well as establishing the amount of recovery. My role is to provide legal representation to enable you to maximize the compensation the law allows you to receive. What is personal injury law: Generally a personal injury lawsuit involves a claim that another person or entity was negligent. To prevail on a negligence claim, one must prove 1) the defendant owed a legal duty to the plaintiff; 2) the defendant breached that duty; 3) the breach of the legal duty was the proximate cause of the injury; and 4) the plaintiff sustained damages.
The existence of a legal duty involves foreseeability. The person injured must be foreseeable and that the probability of harm must be foreseeable. For example, a person driving a car has a legal duty to obey stop signs. If a driver fails to stop at a stop sign, it is foreseeable that another driver will be injured and the injuries sustained in a car collision are also foreseeable.
